1. The operation behind this notice
ELS Fleet Services is the public brand used at formulatrucking.com. ELS TRUCKING & REPAIR LLC operates the site and determines how personal information described in this Policy is handled. References to “ELS Fleet Services,” “we,” “us,” and “our” mean that operator. Privacy correspondence may be sent to [email protected] or to 670 WARREN AVE, ZUMBROTA, MN 55992.
This Policy follows information through the public website, its contact and subscription forms, local preference features, planning and estimator tools, and email or SMS communications. The website is intended only for people who are at least 18 years old.
2. What enters our systems
Information you submit. The contact form collects a name, email address, and message. The subscription form collects first name, last name, email address, an optional mobile number, individual checkbox states, and the exact consent language and version presented when the form is sent.
Request and operational details. A message may include freight origin or destination, equipment type, vehicle or unit details, repair symptoms, timing, service preferences, or other information you decide to provide. Do not use a public form to send payment-card data, passwords, entry codes, government identification numbers, or other sensitive credentials.
Technical records. Hosting, security, and webhook infrastructure ordinarily receives IP address, request time, page URL, browser and device information, referring URL, response status, and diagnostic or security logs. These records arise from operating an internet service; this site does not perform a client-side IP lookup.
3. Consent and communications ledger
For a subscription, we record whether informational email, optional SMS marketing, optional non-marketing service notices, age confirmation, and legal acknowledgment were selected. The payload includes the human-readable consent text, consent version, source page, timestamp, and submitted contact details. This provides an auditable record of the choice made and lets us honor later revocation.
Email newsletter authorization is separate from SMS marketing permission. SMS is optional, and a phone number is required only when SMS is selected. Non-marketing service notices remain a separate preference and are not treated as marketing consent.
4. Tools, drafts, and choices kept on the device
The transport planner can save a draft in the visitor’s browser local storage when the visitor chooses “Save.” A draft may contain route ZIP codes, planning mileage and timing, vehicle details and values, service and coverage selections, handoff conditions and notes, and readiness selections. The draft remains on that device, is not transmitted by the planner, and can be cleared through the planner’s “New plan” control or browser storage controls. The DOT / preventive-maintenance estimator uses vehicle class, mileage, service, urgency, and add-on selections only in memory to calculate the displayed planning range; it does not transmit or retain those entries.
The public tracking guidance checks the format of an entered shipment identifier only in page memory and does not transmit or retain it. Any separately issued authenticated tracking link is outside this public form; the public site has no account or password form and does not create a visitor account.
The privacy banner stores only the essential-only preference needed to avoid repeatedly asking the same question. No public account or authentication backend is configured, and this site does not create an account, collect a password, or claim that a visitor has registered. There is no delayed newsletter modal in the current experience.
5. Why information is used
We use submitted and technical information to deliver the requested newsletter; send SMS marketing only after express written permission; provide separately selected service notices; respond to contact requests; route inquiries; preserve consent and suppression evidence; troubleshoot forms; protect systems against abuse; maintain service reliability; comply with legal duties; and establish, exercise, or defend legal claims. We may also review aggregated operational patterns to improve the site, but TRACKING_ENABLED is false and no analytics, advertising pixel, or behavioral tracker is loaded.
6. Service providers, legal duties, and safety
We disclose personal information to providers that perform necessary functions for us, such as hosting, security, webhook processing, email delivery, text-message delivery, aggregation, data storage, and technical support. They receive only the information reasonably necessary for their assigned work and are expected to process it under contractual restrictions.
We may also disclose information when required by subpoena, court order, or other valid legal process; to protect the rights, safety, property, or security of visitors, the public, our systems, or our operation; to investigate fraud or misuse; to enforce site terms; or in connection with a merger, financing, reorganization, or transfer of business assets where appropriate safeguards apply. These operational and legal disclosures are distinct from selling information or providing it for another organization’s advertising.
7. A closed rule for SMS information
Mobile information, opt-in data, and consent will not be shared with third parties or affiliates for their marketing or promotional purposes and will not be sold. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message service. Those providers may process the number, consent record, routing metadata, delivery events, and opt-out status only as needed to operate the messaging channel.
8. Cookies, tracking, and browser signals
TRACKING_ENABLED is false. The current site does not load analytics cookies, advertising pixels, cross-site behavioral trackers, or third-party cookie libraries. Browser local storage is used only for the privacy choice and for a planner draft that the visitor affirmatively saves. Blocking local storage can prevent these preferences from persisting but does not prevent access to ordinary site content.
Global Privacy Control (GPC) is treated as an instruction to keep optional tracking disabled. Because personal data is not sold or shared for cross-context behavioral advertising, a GPC signal does not need to disable an active advertising system. If optional measurement or advertising technology is introduced later, it will not activate without the legally required choice; we will update this Policy and honor GPC as an opt-out signal where applicable. The footer’s Privacy Choices control can reopen the notice.
9. Keeping records only as needed
Contact inquiries and related operational records are retained for the time needed to respond, administer the request, resolve disputes, and meet legal or accounting obligations. Newsletter records remain while a subscription is active and for a reasonable period afterward to document fulfillment and opt-out. Technical security logs are kept for a limited period appropriate to investigation and system protection. Locally saved planner drafts remain until the visitor clears them or browser storage.
Evidence of SMS opt-in and opt-out is retained for at least four years. Suppression and STOP records are retained for at least ten years, or longer where legally required, so a revoked number is not inadvertently re-enrolled. Litigation holds, regulatory obligations, fraud prevention, and enforceable recordkeeping duties may require a longer period.
10. Safeguards and practical limits
We use reasonable administrative, technical, and organizational measures designed for the sensitivity and context of the information, which may include transport encryption, access controls, provider review, logging, separation of duties, and incident procedures. No website, transmission, or storage system can be guaranteed completely secure. Visitors should avoid sending sensitive credentials through public forms and should contact [email protected] if they believe a submission was misdirected.
11. Communication controls
Every informational or marketing email covered by applicable law will provide an unsubscribe method. An email request can also be sent to [email protected]. To end recurring SMS marketing, reply STOP to a program message; HELP requests assistance. Revoking one channel does not automatically revoke another independently selected channel unless the request clearly says so.
12. U.S. privacy rights — Do Not Sell or Share
Depending on state law and applicable exemptions, U.S. residents may request access to or confirmation of personal information, correction, deletion, portability, or a list of categories of recipients; may opt out of sale, sharing, targeted advertising, or qualifying profiling; may limit certain uses of sensitive personal information; and may appeal a denied request. ELS Fleet Services does not sell personal data or share it for cross-context behavioral advertising.
California residents may exercise rights available under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including rights to know categories, sources, purposes, recipient categories, and specific pieces of personal information; correct inaccurate information; delete information subject to exceptions; receive portable information; opt out of sale or sharing; and receive equal service without unlawful discrimination. The “Do Not Sell or Share” choice is honored by our existing no-sale and no-sharing practice.
Submit a request to [email protected] or by mail to the address in Section 1. Describe the right and the state involved. We may verify identity by matching information already held and may request only what is reasonably necessary for verification. An authorized agent must provide proof of authority, and we may verify the resident directly where law permits. If we deny a request, the response will explain any available appeal process; an appeal can be sent through the same methods with “Privacy Appeal” in the subject line. We will not discriminate against a person for exercising an applicable privacy right.
13. Information about minors
The site and its communication programs are restricted to adults 18 and older. We do not knowingly collect personal information from a child. A parent or guardian who believes a child submitted information may contact [email protected] so we can investigate and delete it where appropriate.
14. Revisions to this record
We may revise this Policy as practices, technology, or law changes. The Last Updated date at the top identifies the version in force. Material changes may also be announced through the site or a communication channel when appropriate. Prior consent is not expanded merely because the Policy changes.
