SMS Terms

1. The optional fleet-finance text channel
ELS Fleet Services offers an optional program of recurring automated marketing text messages concerning fleet-finance education, operating-cost topics, and program news. It may complement the requested educational email newsletter, but the two channels are separate. The SMS program is available only to people age 18 or older.
2. Enrollment is a written choice
By selecting the SMS checkbox, entering a supported mobile number, and submitting the subscription form, you give express written consent for ELS Fleet Services to send recurring marketing texts to that number using automated technology, including an automatic telephone dialing system where applicable. Consent is not a condition of purchase or email subscription. You may subscribe to email without selecting SMS.
You represent that you are the subscriber or customary user of the entered number and are authorized to consent. Your opt-in applies to that number even if it appears on a state or federal Do Not Call list, to the extent permitted by law.
3. Variable frequency and wireless charges
Message frequency varies with program activity; no fixed cadence is promised. Message and data rates may apply under your wireless plan. ELS Fleet Services does not charge a separate fee for the program, but your carrier’s charges remain your responsibility.
4. STOP closes the channel; HELP opens support
Reply STOP to unsubscribe from recurring marketing texts. We may send one confirmation message after the request, and then the marketing messages will stop unless you later provide a new valid opt-in. Reply HELP for help. A reasonable alternative support method is email to [email protected]. We will also honor revocation communicated by another reasonable method as applicable law requires.
5. Delivery depends on the network
The program is available only where the device, number type, carrier, and network support the messages. Delivery can be affected by network congestion, device settings, service changes, and other conditions outside our control. T-Mobile and other carriers are not liable for delayed or undelivered messages. ELS Fleet Services does not guarantee that every message will arrive or arrive at a particular time.
6. The number must remain yours
Notify us promptly if the enrolled number is reassigned, transferred, disconnected, converted to an unsupported number type, or no longer under your control. Until that notice is processed, you are responsible for activity associated with the number. We may suspend or terminate enrollment when a number appears invalid, unsupported, reassigned, abusive, or legally restricted.
7. Mobile data stays within delivery operations
The Privacy Policy explains our broader practices. Mobile information, opt-in data, and consent will not be shared with third parties or affiliates for their marketing or promotional purposes and will not be sold. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message service. Those providers may handle information only as needed to route messages, record delivery, support the program, and honor opt-outs.
8. Program changes and termination
We may modify the program, these SMS Terms, or available topics, or may suspend or end the program, subject to applicable law. A material change will be reflected by a revised Last Updated date and additional notice when required. Ending the program does not erase records that must be retained to prove consent, honor suppression, resolve disputes, or comply with law.
9. Minnesota rules and program contact
Minnesota law governs these SMS Terms except where federal law or a mandatory rule controls. The website’s Terms & Conditions contain the dispute-resolution procedure and are incorporated to the extent relevant to this program.
